As a production company in the audiovisual sector, Woestijnvis frequently comes into contact with personal data and is committed to protecting these data optimally in order to guarantee your privacy. This privacy statement is part of a broader data protection policy and aims to inform you about the way in which Woestijnvis processes your personal data.

Specifically, we will hereby explain how and why Woestijnvis processes your personal data when you are involved in the production of image and sound recordings and/or a television programme by Woestijnvis. This can consist of acting as a participant, extra, actor or presenter in a program, but also attending a recording in the audience or being a candidate in a casting procedure.

However, we would like to point out that data protection and privacy legislation provides a number of exceptions in the context of the processing of personal data for journalistic purposes and for academic, artistic or literary expression. The reason for this is to reconcile the right to data protection and privacy with the rules on freedom of expression and information. Since Woestijnvis, as a production company, is frequently involved in journalistic and artistic work, this privacy statement will in no way affect these applicable exemption provisions.

WHAT PERSONAL DATA DOES WOESTIJNVIS PROCESS?

In the context of its production activities and depending on the type of production, Woestijnvis can process the following data about you:

  • identification data (such as your surname, first name, etc.)
  • contact information (such as your phone number, email address, etc.)

  • data on personal characteristics (such as gender, age, etc.)

  • photographs, image and/or sound recordings, including the personal data that can be derived from them

WHY DOES WOESTIJNVIS PROCESS THIS PERSONAL DATA?

As a production company, Woestijnvis is focused on producing image and sound recordings and television programmes, which are then offered to the viewer through various media channels. The interests of the various stakeholders and the guarantee of quality are essential here. In this context, your personal data may be processed by us for the following purposes:

  • the selection of participants, actors, extras, etc. for a programme,
  • the production of image and sound recordings, including your participation in the making of the programme,
  • the transmission of the image and sound recordings produced and/or the television programme to various media channels for broadcast and subsequent reruns (both via television and other channels (e.g. online)),
  • the transmission of the image and sound recordings produced and/or the television programme in order to make derivative products (such as DVDs, etc.),
  • the online use of video recordings to promote the programme as well as more generally to promote Woestijnvis as a production company (such as publishing image and sound recordings on the website of Woestijnvis, etc.),
  • the use of the image and sound recordings in programmes other than the programme in which you participated as a participant, actor, extra, etc. (such as annual reviews, compilation programs, etc.),

WHEN IS WOESTIJNVIS ALLOWED TO PROCESS THIS PERSONAL DATA?

The processing of personal data is subject to a number of legal provisions and principles. Woestijnvis ensures that these are always respected when we process your personal data. In addition, the processing of your data by Woestijnvis will only be lawful if and insofar as at least one of the following conditions/principles is met:

1. Woestijnvis has obtained your consent to process your personal data

For the processing of certain data, you may, implicitly or explicitly, give permission to Woestijnvis. If this is the case, Woestijnvis will ensure that this consent is always given freely and informed. You have the right to revoke your consent at any time. As a result, Woestijnvis will no longer be able to rely on your consent for the processing of your data from the time of the withdrawal. In any event, this withdrawal shall not affect the lawfulness of the processing carried out on the basis of consent prior to its withdrawal.

2. There is an agreement between you and Woestijnvis and the processing of your personal data is necessary for its execution

If you cooperate in the making of image and sound recordings by or the making of a program by Woestijnvis, an agreement will be concluded between you and Woestijnvis. This inextricably means that Woestijnvis will process image and sound recordings of you in order to safeguard the execution of this agreement.

3. There is a legal obligation for Woestijnvis and the processing of your personal data is necessary to comply with this obligation

As a Belgian company, Woestijnvis is subject to legal obligations, whereby personal data may also be necessary to comply with these obligations. If and to the extent that this is the case, Woestijnvis will be able to process your personal data on this basis (for example, in the context of tax or accounting legislation).

4. Woestijnvis (or a third party) has a legitimate interest in the processing

When Woestijnvis invokes the legitimate interest for the processing of your data, a weighing of interests will always take place beforehand, in which we evaluate whether or not your fundamental rights and freedoms outweigh the interests of Woestijnvis in the processing. In such a case, we will also inform you of our legitimate interest in this processing.

If you do not provide certain personal data to Woestijnvis, even though these are necessary in the context of an agreement with you or because of a legal obligation that rests on Woestijnvis, you will not be able to cooperate in making the image and sound recordings and/or making the television program.

HOW DOES WOESTIJNVIS OBTAIN YOUR PERSONAL DATA?

Woestijnvis may obtain your personal data through various channels, depending on the nature of the collaboration. This acquisition can take place in the following ways, among others:

  • You provide your personal data directly to Woestijnvis, for example by sharing it with employees employed by Woestijnvis,
  • Your personal data is obtained indirectly by Woestijnvis through other channels, such as:
    • Employees who are not employed by Woestijnvis, but who do act on its behalf, for example cameramen, sound engineers, etc.
    • The actors, extras and audience platform In The Picture, or similar platforms.

 

RECEIVERS

In the context of its activities as a production house and with a view to achieving the above-mentioned objectives, as well as in the context of legal obligations, Woestijnvis may share your personal data with:

  • employees of a program who are not employed by Woestijnvis (such as mechanics, etc.),
  • media and distribution channels (such as television broadcasters, written media, social media, etc.),
  • actors, extras and audience platforms (such as In The Picture),
  • operators of our planning tools and other databases,
  • Viewers
  • producers of derivative products (such as DVD producers, etc.),
  • financial and insurance institutions,
  • external consultants,
  • judiciary and police forces,
  • Public authorities

In this context, your data will only be transferred by Woestijnvis outside the EEA if appropriate guarantees are offered regarding your rights.

HOW LONG WILL WOESTIJNVIS KEEP YOUR PERSONAL DATA?

In principle, Woestijnvis will store your personal data for a maximum of 3 years,

  • after the time you have been informed of your non-selection for production, or
  • at the end of the agreement.

However, in the context of certain legal obligations, Woestijnvis will retain certain personal data for a longer period of time. For this personal data, the time limits necessary to comply with such legal obligations are applied.

In addition, we would like to emphasize in this context that visual material and sound recordings will be kept by Woestijnvis for an indefinite period of time, with a view to possible later reruns and the preservation of audiovisual heritage.

WHAT RIGHTS DO YOU HAVE ?

You have the possibility to contact Woestijnvis at any time in regards to exercising your rights, in particular for:

  • access to your personal data,
  • the rectification of your personal data,
  • the erasure of your personal data,
  • the restriction of the processing of your personal data,
  • objecting to the processing of your personal data,
  • the transfer of your personal data,

We would like to point out that data protection and privacy legislation imposes certain conditions of application on the exercise of the above-mentioned rights. This means that, depending on the situation, you may or may not be able to invoke some of the above rights. In this context, Woestijnvis will always comply with the general legal provisions and will also always take into account the applicable exceptions with regard to journalistic work and academic, artistic or literary forms of expression.

In this context, Woestijnvis processes the following data about you:

TERM:

The above data will not be kept by us any longer than necessary for the realization of the above-mentioned purpose. If you are not retained, your personal data will be stored for a maximum of 3 years after the application.
